thomas. i'm kristen sze. in napa firefighters on the scene of a late night house fire. crews were forced to let the house burn on mustang road because there was live ammunition inside making battling the flames unsafe. crews took a defensive position. the flames were contained before 11:30. investigators looking for a cause, nobody was injured. >> the 60 oakland residents driven out of their apartments by a carport fire early tuesday morning won't be going home any time soon. the complex has been declared uninhabitable. the main problem is the fire fried the electrical system it will take between 30 and 90 days to repair. the blaze near lake merritt destroyed six cars, damaged carport and billing, nobody was injured. gilroy police hope to find the mother of an iraq war vet

that investigators killed his 11-year-old sister most likely his mom and then himself. police say 27-year-old abel gutierrez shot and killed his sister wednesday night, their mother is still missing. police believe gutierrez shot his mother too based on forensic evidence at the scene. >> we believe she is critically wounded or deceased. that's why we are asking for the public's help we need to find her to see if she needs medical attention. >> police say gutierrez suffered from post-traumatic stress order. the mother called police last month because she was so worried about his behavior. officers started working with the family to help them get services. the emeryville police department asking for help finding a man they say is armed and dangerous wanted for two robberies, attempted kidnapping, carjacking and sexual battery.

this is 30-year-old man police believe he may working as a security guard, six feet tall weighs about 230 pounds and speaks with a heavy accent. latest assault wednesday night. another woman woman was attacked last saturday. this morning family and friends of a uc berkeley student remain in shock following a fatal accident yesterday morning during a storm. the victim was from washington state and an was attending cal on a bill gates scholarship. >> this is sad, just weird. >> reporter: the death of 19-year-old uc berkeley student kevin lacanlale was new. he hadn't seen the e-mail was sent out. >> just the fact that it is is up a close-knit community it was devastating.

>> reporter: lacanlale died in this accident. chp says lacanlale hit a downed tree in the road he and his passengers got out to check the damage that's when an f-150 also hit the tree. he came to study medicine here on a coveted bill gates academic scholarship. justin used to have movie nights with lacanlale he said his friend was a hard worker who always wanted to help. >> he really liked helping people. and he wanted to apply science in helping people together and medical field seemed the most natural for him. >> reporter: there was a community meeting to talk about what happened and they had a school psychologist on hand in case anybody needed to talk. ama daetz, abc7 news. agreement to a new stadium. councilmembers acting as the

stadium authority approved final documents for a bank loan of up to 950 million dollars. that's 100 million more than the initial estimate. the deal also requires the 9ers to remain in santa clara for at least 40 years following the expected opening in 2014. the lines are long and getting longer outside apple stores. latest version of the popular ipad goes on sale today some camped out overnight. later this morning others will show up to protest. certainly is the protest part of this about? >> reporter: the protest is about concerns raised in the last couple of years more the last year because of suicides that have happened at some of these factories that linked to making the ipad. one of the biggest companies is a company call fox-con suicides at that company in china.

here in san francisco there are quite a few people lined up in front of one of their main stores downtown a lot of the workers in the store have been pepping for in opening all morning -- been prepping for this opening all morning. the first person that i talked to in line says he got here 9 p.m. last night. you can see this line extends down probably half a block. a lot of people have been showing up since we got here that line continues to grow. doors open at this store in downtown san francisco at 9 a.m. this morning. there is some protesters who we are expecting. they say they are going to be here around 8:00. their main concern are wages for a lot of those chinese workers. we are probably going to be hearing specifics about their concerns we'll have more reports coming up throughout the morning. sergio quintana, abc7 news.

people are braving the weather still wet. tzmmxt santa cruz boardwalk depends on the strength of the storm hitting later today. heavy equipment was used to build a sand berm to protect the boardwalk. crews had to cut a new channel so would it flow out to sea instead of under the boardwalk. flood waters have claimed one of the boardwalk's wooden had sprinkles coming in from the east bay. you had more coming in, right? >> yeah, the whole drive, light rain, drizzle. windshield wipers may still need to work this morning. that's key light rain possible steadier north bay. good morning. sausalito, san rafael, novato, petaluma, all the way up to ukiah, we have rain right now.

we'll pull out over the last three hours moving a little south of east which means some of this lighter rain will move farther south in the morning commute wet in a lot of areas it is drier towards the east bay valleys and south bay areas that have been the driest so far out of these storm systems that is going to change into the afternoon. winds fairly light 10 to 15 miles per hour. 8:00 you can see light rain dancing around all of our neighborhoods temperatures in the 50s. towards lunch we'll still have rain hanging around with the heaviest rain starting to move into the north bay, yellows there around santa rosa, temperatures in the mid to upper 50s by 4:00, we have the heaviest of the rain starting to pull into the bay itself, you can see there coming down san rafael, napa, close to san francisco, oakland and concord. primarily an evening event. rain during the day heavy

expected to begin looking for the cause of a helicopter crash near palo alto airport. sky 7 hd was over the scene shortly after the chopper went down the pilot was trying to reach the airport engine trouble forced her to crash land in a marsh the chopper ended up on its side in four feet of water. >> we were initially concerned it may have landed on the highway there may be casualties on the ground the pilot did an outstanding job of putting her aircraft down in an area that didn't expose anyone on the ground to danger. pilot walked away with bumps and bruises. she is expected to be okay. the national transportation safety board and federal aviation administration are involved in the investigation. popular pleasanton water park still has a chance to stay open. yesterday an east bay regional park district committee overruled the staff recommendation to close the
